Agreement to Terms

By accessing or using the David Claude Landscape Design website and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our website or use our services.

David Claude Landscape Design provides landscape architecture, garden design, and construction services in Melbourne, Victoria. Our services include but are not limited to:

  • Retaining wall construction
  • Planting and garden installation
  • Steep block solutions

Quotations and Pricing

All quotations provided are estimates based on the information available at the time. Final pricing may vary based on:

  • Site conditions discovered during construction
  • Changes to project scope requested by the client
  • Material price fluctuations
  • Access restrictions or complications

Quotations are valid for 30 days from the date of issue unless otherwise stated. We reserve the right to adjust pricing if work is not commenced within this period.

Project Terms

Deposits and Payments

A deposit is required before commencement of any design or construction work. Payment terms will be outlined in your project contract. Progress payments may be required for larger projects.

Project Timeline

While we endeavour to complete projects within estimated timeframes, timelines may be affected by:

  • Weather conditions
  • Material availability
  • Council approval processes
  • Changes to project scope
  • Site access issues

We will communicate any significant timeline changes as soon as they become apparent.

Client Responsibilities

Clients are responsible for:

  • Providing accurate information about the property and project requirements
  • Obtaining necessary council permits and approvals (unless otherwise agreed)
  • Ensuring site access for our team and equipment
  • Marking or identifying underground services (water, gas, electrical, telecommunications)
  • Making timely decisions when required
  • Payment according to agreed terms

Intellectual Property

All design concepts, drawings, plans, and specifications created by David Claude Landscape Design remain our intellectual property until full payment is received. Upon full payment:

  • Design plans may be used for the specified project only
  • Designs may not be reproduced or used for other projects without written permission
  • We retain the right to photograph and use completed projects for marketing purposes

Warranties

David Claude Landscape Design provides warranties on workmanship as outlined in your project contract. This warranty does not cover:

  • Plant material (plant guarantees provided separately where applicable)
  • Damage caused by third parties or natural events
  • Issues arising from lack of maintenance
  • Modifications made by others after project completion

Limitation of Liability

To the maximum extent permitted by Australian law, David Claude Landscape Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability for any claim arising from our services shall not exceed the amount paid by you for those services.

Website Use

The content on our website is for general information purposes only. While we strive to keep information accurate and up-to-date, we make no warranties about the completeness, reliability, or accuracy of this information.

You agree not to:

  • Use our website for any unlawful purpose
